Validity of the GTC
The terms of delivery and payment are an integral part of all contracts for the supply of goods and services by geoway emotion GmbH.

Prices
The prices are net plus the respective legal value added tax.

Delivery and delivery period
Delivery is ex works. Delivery times are not binding.

Warranty and guarantee
Geoway emotion GmbH commits itself to 2 years warranty. Defects will only be accepted if the buyer notifies all obvious defects, misreporting or wrong deliveries within 5 days, hidden defects within 90 days, after delivery. All defects based on this shall be rectified by geoway emotion GmbH or a company commissioned by geoway emotion GmbH within a reasonable period of time. A guarantee for the wear and tear of wearing parts, which regularly occurs through use, is excluded. In case of manipulation or repair attempts by the purchaser or third parties, any warranty and guarantee shall expire. Used devices, which are bought from third hand are not allowed for the professional use in studios, hotels etc.. Any warranty claim, guarantee, also the product liability law becomes invalid. Used equipment from third parties can only be used after it has been subjected to an expert opinion or a technical inspection by the manufacturer. After a positive expert opinion has been issued or a technical inspection has been carried out, approval for commercial use can be requested from the relevant authority.

Take-back
Geoway emotion GmbH is in principle not obliged to take back delivered goods.

Ownership
The goods remain the property of the company until full payment has been received.

Disclaimer
Claims for damages arising from impossibility of performance, from culpa in contrahendo and from tort are excluded both against geoway emotion GmbH and against vicarious agents of geoway emotion GmbH.

Place of performance
For all deliveries and services, the
court with subject-matter jurisdiction in Leibnitz shall apply for both
parties. These GTC and the contracts to be concluded under these GTC
shall be governed by Austrian substantive law. The uniform UN sales law
is excluded.
